Waiver & Release
Because physical exercise can be strenuous and subject to risk of injury, including serious injury or death, the Club urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You (each member, guest, or participant) agree that if you engage in any physical exercise or activity, or use any club amenity on the premises or off premises including any sponsored club event, you do so entirely at your own risk. Likewise, dietary modifications can cause a variety of changes and can create problems, including as it relates to your energy, stamina, appetite, and mood. Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in these activities and use of these facilities and assume all risk of injury, illness, or death. We are also not responsible for any loss, damage, or disappearance of your personal property.
This waiver and release of liability includes, without limitation, all injuries which may occur, as a result of: (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction; (b) the sudden and unforeseen malfunctioning of any equipment; (c) our instruction, training, supervision, or dietary recommendations; (d) any on-line or virtual training; or (e) your slipping and/or falling while in the club, or on the club premises, including adjacent sidewalks and parking areas. This waiver also includes any claim associated with the presence of or transmission of any bacteria, viruses, or infectious diseases.
You understand that the Club occasionally photographs/videotapes client events/sessions and you consent your approval for the Club to use these images or video in any and all media for promotional purposes with no financial or other remuneration due to you.
By submitting below, you acknowledge that you have carefully read this "waiver and release" and fully understand that it is a Release of Liability. You expressly agree to release and discharge the club, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the Club for negligence, personal injury or property damage.

Donny Day has many certifications by National Academy of Sports Medicine, Cooper Institute, American Fitness Training of Athletics, American Council on Exercise, Pilates, Personal Training Fundamentals, Corrective Exercise Specialist, Walking & Running Certification, General Nutrition, Sports Specific Nutrition, and The Fundamentals of Fitness through Bally Total Fitness.
Within the almost 15 years of his experience, Donny has mentored over 100 Fitness Managers, 1000 Personal Trainers and over 40,000 Clients to success in the art of program design, nutrition, and more. He has worked for Bally Total Fitness, LA Fitness, and Just Fitness. With over 15 collective company awards to his name, and multiple large-scale program designs to his name, Donny has helped thousands of members reach their desired fitness level.
He has knowledge of big corporate gyms, 1-on-1 personal training, group classes, and every other system. With his vast experience, he created the Peak Zone Fitness program to fill what he saw as a gap in the industry: 1-on-1 personal training in a group setting that is truly individualized to specific client needs.
It’s a program in which clients are using science to eliminate guessing as well as giving every client a vast knowledge about fitness and nutrition. He created a program that not only gives clients the most knowledge possible but gives the trainers a greater collective wealth of knowledge than any single certification could. Peak Zone Fitness Trainers have to complete a 300-page book and 90-day training course before they begin running the program.

Peak Zone Fitness™ is a yearlong training program. It is made up of over 1500 different exercises (6X the average program) and 800 totally different workouts. This means clients only see the same workout once per year. Because we use progressions, digressions, our quality of contraction board, heart rate monitors and overly certified expert fitness directors to constantly monitor your every workout Peak Zone Fitness™ is designed to cater to any fitness level or goal and is completely individualized. Donny Day is one of the fortunate people who knows what he wants early in life.
“I was young enough to want it so bad. And after spending countless hours training with other trainers, following them around, taking notes from everybody, begging for information, and doing all my certifications, before I knew it, I became the number one trainer for Bally Total Fitness in the State of Texas. And I was just 18 years old when that happened.”
By the time he reached 20 years old, he had an opportunity to move to Los Angeles and work at LA Fitness. Striving to be the best fitness trainer he could be, Donny used the experience to excel, working 12 hours a day, and promoting to Manager.
Eventually, Donny moved back to Texas to train private clients and obtain new certifications to improve his fitness knowledge. Shortly after, he became a Manager for Just Fitness’ Personal Training Department where he broke multiple sales records, and was promoted to Vice President for their 20 million dollar project with 20 clubs. During his time as Vice President Donny Day visited and studied the nation’s top fitness trends in order to build various personal training and group personal training programs within the Just Fitness business.
Using insight from his previous work, letting experiences mold him, and learning from his obstacles, Donny Day then created Peak Zone Fitness, a fitness startup featured in over 200 different media outlets and loved by its customers with over 600 perfect reviews.
